Law 5344/2026 was published on October 16 (Government Gazette A). The text that was voted on is not what we were discussing. The start dates, deadlines and criteria for the levels have changed. Law 4640/2019 is repealed before the new system enters into force, on March 1, 2027.. The provisions on cadastral mediation (articles 96–101) are in force since publication.
Most colleagues haven't read the Government Gazette yet. The first unacceptable ones won't wait to read it.
If you are a lawyer
- If you do not submit the memorandum of the introductory session together with the proposals, the discussion of the lawsuit is declared inadmissible (article 79, paragraph 14).
- If the mediator does not issue the memorandum on time, the risk is borne by your principal.
- A document that is not posted on the Digital Portal within 10 working days loses its enforceability (article 83).
- Unjustified abstention costs a penalty of up to €1,000 and the entire fee for the introductory session (articles 18, 125).
- The old and new mediation clauses no longer follow the same rules (articles 85, 155 par. 11).
If you are a mediator
- You have two months to submit your experience file. Otherwise, you will automatically be classified in the 3rd level, which only accepts cases up to €60,000 by appointment (articles 123, 155 par. 3).
- If you do not issue the memorandum on time, you will be subject to disciplinary action and a six-month ban from appointments (article 79, paragraph 15).
- If you fail to respond to an appointment a second time within a year, you are automatically removed from the appointment queue (article 124).
- From 1.3.2027, family and cadastral mediation can only be carried out by anyone with a special mark (articles 93, 98).
